Welcome To Nimbus Education Website (“The Website”) and/or Nimbus Education App (“The App”). The Website and App are fully owned and controlled by Nimbus Education, having its registered office at SCO-128-129, Sector 34, Chandigarh. The Website and the App shall hereinafter be collectively referred to as “the Platform”. For the purposes of this Terms of Use, Accessing of the Platform together with any study material made available or uploaded therein or downloaded, embedded therefrom shall herein collectively be referred to as the “Services”.
By enrolling, registering, or purchasing any of Nimbus Education’s services, it is deemed that the user has read and understood the terms and conditions carefully and agrees fully to all the points mentioned in it. The user is bound by these terms in use for the complete validity of the product or services offered to him/her.
These terms and conditions can be altered at any point of time at the sole discretion of Nimbus Education without given any written notice. These changes shall apply to any product or service purchased by the user after any such change is posted on Nimbus platform. It is advised to review these terms and conditions as and when you are purchasing any product or service at Nimbus platform. If you do noy agree to the terms mentioned, then it is advised to refrain from registering or purchasing any product or service from Nimbus platform.
1. ELIGIBILITY
- You are of sound mind.
- You are not prohibited from entering into a legally binding contract as per applicable laws.
In case the Platform is being accessed and the Services are being availed for the benefit of a minor, you expressly confirm that you are legally competent to provide consent on behalf of such a minor and that the minor’s use of the Platform and/or the Services shall be subject to the Terms of Use.
2. YOUR ACCOUNT
Nimbus Education reserves the right and sole discretion to refuse access to the Platform, terminate any account, remove or restrict any content, at any time, with or without notice to you in case we notice any illegal activity on or from account or if we have reasons to believe that any information provided by you is untrue, inaccurate, outdated or incomplete.
3. RESTRICTION AND TERMINATION OF USE
Nimbus Education may block, restrict, disable, suspend or terminate your access to all or part of the free Services offered on the Platform, at any time in Nimbus’s sole discretion, without prior notice to you upon Nimbus Education. Specifically, in case of prolonged inactivity, Nimbus reserves the right to disable, deactivate or terminate a user’s account. If an account has been disabled or deactivated for inactivity, the user name associated with that account may be given to another user without notice to you or such other party. If you violate the Terms of Use, Nimbus Education may at its sole discretion, block, restrict, disable, suspend or terminate the paid Services offered on the Platform.
4. INTELLECTUAL PROPERTY
The Services, including but not limited to digital content on the website i.e. text, graphics, user interface, images, video interface and software as well as their selection and arrangement, may belong to Nimbus Education or to its partners who have granted Nimbus Education the right to use their content and are protected to the fullest extent possible by applicable laws related to copyrights, trademarks, trade secrets and all other intellectual property and proprietary rights (collectively, “Intellectual Property Rights” ). Any unauthorized use of the Services may violate such laws and the Terms of Use. Nimbus Education reserves all its legal rights to prohibit, stop or contain any such violations.
You agree not to copy, republish, frame, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the Platform and Services or any parts thereof or the selection and arrangement of the Platform and Services, except as expressly authorized herein. Nimbus Education grants you a non-exclusive, non-transferable, limited permission to access and display the web pages within this Platform, solely on your computer or any other electronic viewing device for your personal, non-commercial use of this Platform. This permission is conditional on the basis that you shall not modify, alter or illegally use the content displayed on this Platform and shall keep intact and comply with all copyright, trademark, and other proprietary notices of the Platform, if any. The rights granted to you constitute a license and not a transfer of title in any manner.
In relation to any content submitted, uploaded or generated by you on the Platform, you hereby grant an unconditional, unlimited, perpetual, royalty-free, worldwide license and permission to Nimbus Education and its affiliates, content sharing partners to display, store, host, publish, digitally reproduce or copy, transmit, communicate, modify, translate, distribute or otherwise make such content available on the Platform or in relation to the Services provided by Nimbus Education. You agree that such content may continue to be made available on Nimbus Education despite any termination or suspension of your account, if such content has been shared, stored or embedded by any other user(s). You agree to not hold Nimbus Education responsible for the aforesaid activities in relation to your content.
5. USER CONTENT
Nimbus Education provides its users the option of creating posts and/or upload content on the Platform (“User Content”). When you submit or upload any content on the Platform you represent and warrant that:
- You own all copyright in the content, or if you are not the owner, that you have permission to use the content, and that you have all the rights and permissions necessary to permit uploading, displaying, sharing, reproduction, downloading, transmission of such content.
- The content you upload will not infringe the intellectual property rights or other rights of any person or entity, including but not limited to copyright, moral rights, trade mark, patent or rights of privacy or publicity.
- Your use of the Platform will comply with all applicable laws, rules and regulations.
- The content does not contain material that defames or vilifies any person, people, races, religion or religious group and is not obscene, pornographic, indecent, harassing, threatening, harmful, invasive of privacy or publicity rights, abusive, inflammatory or otherwise objectionable.
- The content is not misleading and deceptive and does not offer or disseminate fraudulent goods, services, schemes, or promotions.
Nimbus Education reserves the right to review such content uploaded by the user and in case any content is found to be violation of any of the Terms of Use and/or any applicable laws, Nimbus Education may remove any content from the Platform and/or terminate or suspend the user account in its sole discretion.
6. SITE CONTENT
Nimbus Education Content
Except as may be otherwise noted, the information, materials (including, without limitation, HTML, text, audio, video, white papers, press releases, data sheets, product descriptions, software and FAQs and other content) available on or from this website (collectively, “Nimbus Education Content”) are the copyrighted works of Nimbus Education and its licensors/associated authors expressly retain all right title and interest in and to the Nimbus Education Content, including, without limitation, all intellectual property rights therein and thereto. Except as expressly permitted in these Terms of Use, any unauthorised usage of the Nimbus Education Content by anybody who is outside Nimbus Educations Management or anywhere outside Nimbus Education website or event supported by Nimbus Education, will be treated as the violation of copyrights and/or other applicable laws.
Third Party Content
In addition to Nimbus Education Content, the Site may contain information and materials provided to Nimbus Education by third parties (collectively called as “Third Party Content”). Third Party Content is the copyrighted work of its owner, which expressly retains all right title and interest in and to the Third Party Content, including, without limitation, all intellectual property rights therein and thereto. In addition to being subject to these Terms of Use, Third Party Content may also be subject to different and/or additional terms of use and/or privacy policies of such third parties. Please contact Nimbus Education Management or appropriate third party for further information regarding any such different and/or additional terms of use applicable to Third Party Content.
Limited Usage of Site Content License
Except as provided in Section (i)below, Nimbus Education grants you the limited, revocable, non-transferable, non-exclusive right to use the Site and the associated Nimbus Education Content and Third Party Content (collectively, “Site Content”) by displaying the Site Content on your computer, and downloading and printing pages from the Site under the condition that (i) such activity is solely for your personal, education or other non-commercial use, (ii) you do not modify or prepare derivative works from the Site Content, (iii) you do not obscure, alter or remove any notice of copyright set forth on any Site pages or Site Content, (iv) you do not otherwise reproduce, re-distribute or publicly display any of the Site Content and (v) you do not copy any Site Content to any other media or other storage format.
User Content
If you elect to display, post, submit or otherwise make available to others, on the Site any content or works of authorship, including, without limitation, images, software, audio files, text, or any other materials (collectively, “User Content”), you hereby grant to Nimbus Education a perpetual, irrevocable, royalty-free, worldwide, non-exclusive right and license, including the right to grant sublicenses to third parties, to use, reproduce, publicly display, publicly perform, prepare derivative works from and distribute such User Content, for any purpose. In addition, you hereby irrevocably represent and warrant to Nimbus Education that (i) you have all necessary power, authority, right, title and/or licenses to grant to Nimbus Education the foregoing right and license and (ii) the posting, submission, display by you of User Content on the Site, and the exercise by Nimbus Education of the foregoing license does not and will not (1) violate any law or (2) infringe any intellectual property right of any third party. You hereby irrevocably agree to indemnify, defend and hold Nimbus Education, its affiliates, directors, officers, employees and agents harmless from and against any and all loss, costs, damages, liabilities and expenses arising out of or related to any third party claim resulting from a breach of the foregoing representations and warranties.

Submission of User Content
Prohibited Conduct
You may not use the Site to post, transmit or link to (i) any advertisement, promotional materials or solicitation related to any product or service that is competitive with Nimbus Education products or services or (ii) software or programs which contain any harmful code, including, but not limited to, viruses, worms, time bombs or Trojan horses. You may not deploy to the Site any robot, spider, site search/retrieval application, or other application designed to retrieve, index, “data mine,” information from the Site.
Registered Users
If you become a registered user of the Site in order to gain access to support or other limited access parts of the Site, you agree (i) that the information you provide to Nimbus Education in connection with your registration will be current, complete and accurate, (ii) not to choose a user name that violates any law or the intellectual property rights of others, or is offensive; provided that Nimbus Education reserves the right to reject the use of any user name for any reason or no reason, (iii) not to transfer, sell, convey or assign the right to use the Site to any third party without the prior written consent of Nimbus Education and (iv) not to permit any third party to use your user name and password to access the Site. You further agree that you are responsible for the conduct of any party that uses your account, whether or not authorized by you, and for any breach of the security of the Site related to the use of your user name and/or password.

The Site may contain links to other websites that are not owned or operated by Nimbus Education, and you agree that Nimbus Education provides links to such websites solely as a convenience and has no responsibility for the content or availability of such websites, and that Nimbus Education does not endorse such websites or any products or services associated therewith. Your use of such websites will be subject to the terms of use applicable to each such website.
9. CANCELLATIONS AND REFUND POLICY
Cancellations: As a rule, all sales made on Nimbus Education are final and you shall not be entitled to cancel your order once you have received confirmation of the same. Nimbus Education reserves the sole right to cancel any order as per our discretion in case (i) we are unable to deliver the order in a satisfactory manner and/ or (ii) the user tries to take advantage of the system which violates the Terms of Use. Nimbus Education will ensure that any communication of cancellation of an order or any applicable refund will be made within a reasonable period of time.
Refunds: You shall be entitled to a refund only if Nimbus Education is unable to deliver your order. For refund requests please email to info@nimbuseducation.in for test series and live classes within 48 hours of date of purchase. All refunds will be processed on a pro-rated basis, depending on the service already delivered by Nimbus Education. Refunds will be done directly to the original payment mode within seven working days of finalization of claim.
10. ADVERTISEMENTS AND PROMOTIONS
You acknowledge and agree that Nimbus Education is not responsible or liable for any loss or damage of any kind incurred as the result of any such dealings or as the result of the presence of such non- Nimbus Education advertisers on the Platform.
Additionally, by agreeing to this terms and conditions document you authorize Nimbus Education Education, Nimbus Education App and Partner Institute to send messages/e-mails or call you on your registered contact number/e-mail id regarding our different product offerings and discount schemes.
11. LINKS TO THIRD PARTY WEBSITES
The Platform may include links that redirect you to other websites. These third party websites are not covered by the Terms of Use. You agree that once you leave our servers, any third party websites that you go to or interact with are at your own risk. Nimbus Education shall not be held liable for any default, loss of function or any risk or consequence that you may be exposed to as a result of the same.
12. SPAM E-MAIL AND POSTINGS
In the event your access or use of the Platform and Services is found to be spammy, misleading, malicious, annoying or containing/promoting unsolicited e-mails or network postings, Nimbus Education reserves its right to obtain immediate injunctive reliefs against you or against such use by you, in addition to all other remedies available at law or in equity. Nimbus Education may also opt to block, filter or delete unsolicited e-mail, messages or postings as per its sole discretion.
13. INDEMNITY
You agree to indemnify, defend and hold Nimbus Education and its officers, directors, partners, employees, agents and representatives harmless, from and against any and all claims, damages, losses, liabilities, costs (including reasonable legal fees) or other expenses that arise directly or indirectly out of or from
- Your user content and any other content (e.g. computer viruses) that you may submit, post to or transmit through the Platform (including a third party's use of such user content (e.g. reliance on the accuracy, completeness or usefulness of your user content).
- Your access to or use of the Platform and Services (including any use by your employees, contractors or agents and all uses of your account numbers, user names and passwords, whether or not actually or expressly authorised by you, in connection with the Platform and Services).
- Your breach of any clause of the Terms of Use.
- Any allegation that while using any of the software made available on the Platform you infringe or otherwise violate the copyright, trademark, trade secret or other intellectual property or other rights of any third party and/or any dealings between you and any third parties advertising or promoting or linked via the Platform.
- Your activities in connection with the Platform.

Nimbus Education may amend the Terms of Use and other Nimbus Education Policies published on the Platform from time to time at its sole discretion. Your continued access or use of the Platform and Services constitutes your acceptance of the amendments.
